Agreement to Terms

By accessing and using Sugar's (sugardating.ch) pre-registration service and website, you agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our service. These terms constitute a binding legal agreement between you and Sugar.

Pre-Registration Service

Sugar currently provides a pre-registration service that allows you to register your interest in our forthcoming platform. Pre-registration:

• Does not guarantee access to the platform upon launch
• Does not create a paid membership or subscription
• Provides priority consideration for early access based on registration date
• Can be cancelled at any time by requesting data deletion
• Reserves the right for Sugar to manage platform access as we deem appropriate

Eligibility Requirements

You must meet these requirements to use our service:

• Be at least 18 years old (the age of majority in Switzerland)
• Have the legal capacity to enter into binding agreements under Swiss law
• Reside in Switzerland or have a legitimate interest in Swiss-based sugar dating
• Comply with all applicable Swiss and local laws and regulations
• Not be prohibited from using our service under any applicable law

By registering, you represent and warrant that you meet all eligibility requirements.

Acceptable Use Policy

You agree to use our service responsibly and not to:

• Provide false, misleading, or inaccurate information during registration
• Register multiple accounts using different email addresses to circumvent our policies
• Use automated systems, bots, or scripts to register or access our service
• Attempt to interfere with, disrupt, or compromise our service's security or functionality
• Violate any applicable laws or regulations
• Use our service for any illegal, fraudulent, or harmful purpose
• Harass, abuse, or harm other users or our staff
• Attempt to gain unauthorised access to other users' accounts or information

Violations may result in immediate termination of your registration and potential legal action.

Intellectual Property Rights

All content on sugardating.ch, including but not limited to text, graphics, logos, images, software, design elements, and trademarks, is the exclusive property of Sugar and is protected by Swiss and international copyright, trademark, and intellectual property laws. You may not:

• Copy, reproduce, or distribute our content without written permission
• Use our trademarks or branding in any way that suggests endorsement
• Reverse engineer, decompile, or attempt to extract source code from our platform
• Create derivative works based on our platform or content

Disclaimer of Warranties

Sugar provides this pre-registration service "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Warranties regarding the accuracy or reliability of information
• Guarantees of specific launch dates or features

We make no warranties about the future platform's availability, features, or suitability for your specific needs.

Limitation of Liability

To the fullest extent permitted by Swiss Federal law, Sugar and its directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use our service
• Damages resulting from unauthorised access to your information
• Any other damages whether based on contract, tort, or any other legal theory

Our total liability for any claims arising from our service shall not exceed CHF 100.

Indemnification

You agree to indemnify, defend, and hold harmless Sugar and its directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of our service
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

Modifications to Terms

We reserve the right to modify, amend, or update these Terms of Service at any time at our sole discretion. Changes will be effective immediately upon posting to our website. Material changes will be communicated to registered users via email where reasonably practicable. Your continued use of our service after changes are posted constitutes acceptance of the modified terms.

Termination

We reserve the right to terminate or suspend your pre-registration at any time, with or without notice, for any reason including:

• Violation of these Terms of Service
• Fraudulent or suspicious activity
• Requests from law enforcement or regulatory authorities
• Technical or security concerns
• Discontinuation of the pre-registration service

Upon termination, your data will be handled according to our Privacy Policy.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Switzerland, including the Swiss Code of Obligations (OR) where applicable. Any disputes, claims, or controversies arising from these terms or our service shall be subject to the exclusive jurisdiction of the courts of the Canton of Zurich, Switzerland. You consent to the personal jurisdiction of these courts.

Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us. We'll make reasonable efforts to resolve disputes amicably within 30 days.

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Sugar regarding your use of our pre-registration service and supersede all prior agreements and understandings.
